1. Siam or Thailand has failed in her democracy for the last 76 years since 24 June 1932. Citizens are now sick and tired of politics in the country however they are concerned how democracy can be achieved. As a person of second generation in the period when democracy was brought from western countries, I have witnessed the undemocratic Thai politics of least 60 years. Therefore my observation and views may be useful to explain to readers and visitors, especially the foreign press, to understand the parliamentary democracy system ongoing since 1932 in Thailand.

A Why has democracy not worked so far in Thailand.?
B How would democracy be achieved to some extent.?

-ึงกระนั้นก็ยังรักและเป็นห่วงว่าประเทศจะประสพความสำเร็จกับประชาธิปไตยแบบตะวันตกไ"้อย่างไร? ในฐานะที่เป็นคนรุ่นสองหลังรัฐประหาร
24 มิ.ย. 75 ผมจึงไ"้เห็นเหตุการ"์ประชาธิปไตยครึ่งใบประมา" 60 ปีที่ผ่านมา "ังนั้นข้อสังเกตและทัศนะสั้นๆของผมน่าจะชี้เงื่อนปม
ให้เกิ"ความเข้าใจกับพลเมืองไทยของเราเองและชาวต่างประเทศ (ไม่ว่าจะเป็นนักท่องเที่ยวและนักข่าวต่างประเทศ) คือ :-
ก ทำไมประชาธิปไตยระบบรัฐสภาจึงไม่ทำงานหรือไม่มีประสิทธิภาพเอาเสียเลยในประเทศไทย ?
ข ทำอย่างไรประชาธิปไตยระบบรัฐสภานี้จึงควรประสบความสำเร็จไม่มากก็น้อย ?

Since King Chulalongkorn, Rama V (1853 _ 1910) Siamese students were given scholarships by our kings. Until 80 years ago, during the reign of King Prajadhipok, Siamese students in Europe had organized their secret meetings many times. In Thailand, the first bloodless coup d’etat was held on 24 June 1932 while His Majesty was at the palace in Hua Hin. Once he came back to Bangkok, he agreed to accept the role as monarch under the constitution instead of absolute monarchy that had been in the country for centuries. As a matter of fact, King Prachadhipok (1893 _ 1941) had laid the foundation of democracy even before that
incident. Siam already had the first constitution and had elected members of parliament. Only a year later, the sign of political instability began and a cycle of parliament dissolutions, elections, coup d’etat, and constitution drafts continued for 76 years. The unfortunate change could be regarded as premature decision and action. More importantly, those royal government officials copied or imported western democracy to our country that the human element was not ready. If the country had gained more strength through western democracy that would be helpful, however it has not been what we hoped for.

Suppose the country were a human being, the term of bad Karma could be applied. We just did not know why things went wrong despite the fact that Thailand is rich in culture and resources. Before and after 1932, we believed that our democratic founders had good ideal philosophy and were clean in deed. Years and years later, some of those forgot or gave up their honesty. It turned out those who were not active in politics became poor and lived under bad conditions, while many politicians became opportunists and their children have had good lives through the corruption of power and money. The Thais have at least 2 funny proverbs : “Kick a piece of pork that rolls into the mouth”, “Beat a snake and feed it to a crow”. (Or, hard work does not bring rewards to the worker, but, a dishonest, immoral or opportunistic person grasps the benefit without hesitation ...)

ตามภาษิตโบรา"ว่า “เตะหมูเข้าปากหมา” และ “ตีงูให้กากิน” (ความหมาย : ต่อสู้อย่างเหน็"เหนื่อยแต่ผลสำเร็จกลับไปอยู่กับผู้ที่มิไ"้มีส่วนร่วม)
ต้องยอมรับความจริงว่าลูกหลานเหลนของบรรพบุรุษผู้มีอุ"มคติและต่อสู้เพื่อส่วนรวมยังต้องมีชีวิตอยู่อย่างรันท" ข"ะเ"ียวกันบรรพบุรุษ
ผู้ทำลายอุ"มคติตนเองแล้วเปลี่ยนเป็นเรื่องผลประโยชน์จนทำให้ลูกหลานเหลนผู้สืบทอ"มร"กยังนั่งลอยหน้าลอยตากันให้เห็นทุกวันนี้

2. The western countries have had their long history of democracy while their structure of national foundation became stronger and stronger. The following large triangle can represent the broad and basic foundation for each individual, group, city, state and the nation. If all of these entities are strong, we can be sure that democracy tends to be effective. However, there are at least 2 countries with unstable governments in the past - France and Italy, while their citizens have never let their countries collapse.

There is nothing wrong that each citizen has only 4 seconds to vote and directly or indirectly elect the candidates who
can represent and work on the behalf of voters. The effectiveness depends on 4 main factors :-

1 The process methodology achieved by check and balance. 3 The quality of each citizen.
2 The quality of citizens’ candidate or representative 4 The quality of each state - worker.

who are supposed to be volunteers.

แน่นอนประเทศซีกตะวันตกไ"้มีประวัติศาสตร์อันยาวนานต่อการพั'นาระบอบประชาธิปไตยในเรื่องลักษ"ะและวิธีการ ข"ะเ"ียวกัน
โครงสร้างพื้นฐานของชาติก็จะต้องแข็งแกร่งและแข็งแกร่งยิ่งขึ้น รูปสามเหลี่ยมใหญ่หน่อยที่ปรากฏในหน้าแรกนั้นอาจใช้เสนอโครงสร้างพื้นฐาน
กว้างๆแทนส-านะของบุคคล _ ค"ะ _ ชุมชน _ เมือง _ นคร _ ประเทศ... ว่าจะแข็งแกร่งและมีคุ"ภาพไ"้อย่างไร? หากเป็นไปตาม
วัต-ุประสงค์แล้วไซร้ ก็เชื่อแน่ว่าทิศทางเข้าสู่ประชาธิปไตยจะมีประสิทธิภาพยิ่งขึ้น อย่างไรก็ตามก็ยังมีตัวอย่างให้เห็นในอ"ีตว่าแม้แต่
ฝรั่งเศสและอิตาลี่นั้นไ"้รัฐบาลที่ต้องล้มแล้วล้มอีกทั้งๆเป็นประเทศที่เจริญ นั่นก็หมายความว่าจะอยู่ในส-านะใ"ก็ตามหากเจริญก้าวหน้าใน 3
มุมของสามเหลี่ยมใหญ่ในหน้าแรกนั้นแล้ว ก็จะเป็นฐานสำคัญของระบอบประชาธิปไตย
เมื่อพู"-ึงระบอบประชาธิปไตยตามตำรานักเรียนเยาว์วัย จน-ึงชั้นมัธยมสูงๆ และท้ายสุ"ระ"ับอุ"มศึกษา จะกล่าว-ึง 3 อำนาจ
"ั่งปรากฏข้างบนให้เห็นตรง 3 มุมของสามเหลี่ยมเล็ก-ึงฝ่ายนิติบัญญัติ ฝ่ายบริหาร ฝ่ายตุลาการ
สมาชิกหรือผู้อาสามารับใช้ประชาชน โ"ยประชาชนเลือกโ"ยตรงจากการลงคะแนนภายในเวลา 4 วินาทีเท่านั้น จากนั้นเป็นการเลือกกันเอง
เพื่อให้ไ"้ผู้นำ(-ือว่าเป็นการเลือกโ"ยอ้อม) ส่วนบุคคลากรของแต่ละฝ่ายนับจากระ"ับสูงลงมาจน-ึงระ"ับล่างๆในประเทศไทยนั้น-ือว่า
“เป็นข้าราชการ รับใช้สนองพระราชา” “เป็นพนักงานของรัฐบาล” “เป็นลูกจ้างของประชาชน”
-ึงแม้ประชาชนจะใช้อำนาจของตนเองเพียง 4 วินาทีนั้น จะเห็นว่าบัญญัติ 4 ประการ"ั่งกล่าวข้างล่างย่อมจะเป็นตัวชี้ว่าระบอบประชาธิปไตย
มีประสิทธิภาพมากน้อยแค่ไหน ? คือ :-

1 วิธีการหลายๆอย่างอย่างมีประสิทธิภาพเพื่อให้ไ"้มาตั้งแต่ผู้นำลงมา-ึงบุคคลากรของทุกระ"ับ ของทั้ง 3 มุมของสามเหลี่ยมเล็ก
2 คุ"ภาพของผู้สมัครหรือผู้แทนของประชาชนในมุมใ"มุมหนึ่งของสามเหลี่ยมใหญ่ว่าอาสาเข้ามาทำงานเพื่อประชาชน
จริงใจมากน้อยเพียงใ"?
3 คุ"ภาพของพลเมืองแต่ละคนว่ามีความนึกคิ"ตามพื้นของตนเหมาะสมกับทั้ง 3 มุมในสามเหลี่ยมใหญ่อย่างไร?
4 คุ"ภาพของข้าราชการ _ พนักงาน _ ลูก

3. Most democratic countries set their elections every 4 years. Thailand has hoped to follow that election tradition or even retain our constitution, however throughout the past 76 years after 24 June 1932, the country often had political crises : Prime Ministers have resigned 21 times. Prime Ministers have dissolved the parliament 11 times, while 18 coup d’etat have occurred. Before the present constitution (2007), Thai people thought the 1997 constitution was the best so far since several independent agencies were created - The Election Commission, the National Counter Corruption Commission, The Ombudsmen, The State Audit Commission, The Public Prosecutors, The National Human Rights Commission and The National Economic Social Council, etc. All of these national bureaus and independent agencies are regarded as the 4th power, “Checking & Inspecting”. Therefore, the small triangle eventually becomes a Square of Powers for the purpose of check and balance.

ประเทศที่มีประชาธิปไตยทั้งหลายต่างก็กำหน"ทุกๆ 4 ปีเป็นวันเลือกตั้งของตำแหน่งผู้นำหลายๆระ"ับคือระ"ับประเทศ _ ระ"ับภูมิภาค
_ ระ"ับท้อง-ิ่น (บางแห่งทุก 2 ปี แต่น้อยมาก) ประเทศไทยหวังจะมีเช่นนั้นเพื่อให้การเลือกตั้งเป็นไปตามประเพ"ีหรือให้เป็นไปตามรัฐธรรมนูญ
แต่ปรากฏว่าทั้งหม" 76 ปี หลังการรัฐประหาร 24 มิ.ย. 2475 ประเทศต้องพบกับวิกฤติการ"์การเมืองคือ......นายกฯ ลาออก 21 ครั้ง นายกฯ
ยุบสภา 11 ครั้ง รัฐประหาร 18 ครั้ง ปัจจุบันเรามีรัฐธรรมนูญปี 2550 ซึ่งน่าจะเป็นรัฐธรรมนูญที่"ีที่สุ"เพราะเป็นการขั"เกลา และอุ"ช่องโหว่ของ
รัฐธรรมนูญปี 2540 ซึ่งตอนนั้นต่างก็คิ"เห็นกันว่า"ีทีเ"ียวเพราะมีองค์กรอิสระเพิ่มขึ้นเพื่อตรวจสอบการใช้อำนาจในทางมิชอบ _ ในทาง เลือกปฏิบัติ
_ ในทางทุจริต _ ในทางริ"รอนสิทธิมนุษยชน _ ฯลฯ คือ ค"ะกรรมการเลือกตั้ง ผู้ตรวจการแผ่น"ิน ค"ะกรรมการป้องกันและปราบปราม
ทุจริตแห่งชาติ ค"ะกรรมการตรวจเงินแผ่น"ิน ค"ะกรรมการสิทธิมนุษยชนแห่งชาติ เป็นต้น "ังนั้นรัฐธรรมนูญและตำรารัฐศาสตร์จึงควร
เน้นให้ชั"ไปเลยว่านี่คืออำนาจที่ 4 ซึ่งควรเรียกเต็มยศว่า “อำนาจฝ่ายตรวจสอบ” นั่นก็คือสามเหลี่ยมเล็กที่เคยมี 3 อำนาจอยู่บนสามมุม
นั้นก็จะกลับกลายเป็น 4 เหลี่ยมจตุรัส "ั่งปรากฏให้เห็นข้างบนในลักษ"ะเป็นการคานอำนาจ

4. Of all of four powers identified above, The Judicial Power seems to be the institution that Thai people could hope for fairness and justice. Remember, all judges perform on the behalf His Majesty the King. The judges are enthroned in a position of revered worship and shall not be violated, also each holds position of supreme figurehead of the country and in the armed forces. Monarchy has reigned in several kingdoms even before Siam and Thailand in the Suvarnabhumi Peninsula for many centuries. As a kingship, His Majesty the King would follow a special Dharmma, 10 ethics, toward his own citizens _ _ Dhospit Rajadharmma. No matter who is good, bad, powerful, or crooked, people, each one has to respect the monarchy _ Therefore, any defendant found guilty, he or she must go to prison. All courts have been independent, but at one time they were attached with the Ministry of Justice. At the present time new modern courts have been created for more convenience and better judgement.

ลองนึก"ูว่าหากประเทศไทยขา"โครงสร้างที่แข็งแกร่งอยู่แล้วและก็ยังขา"พระมหากษัตริย์ซึ่งเป็นพระประมุข _ เป็นจอมทัพ _
เป็นผู้ทรงอำนาจ _ เป็นผู้นำของปวงชน ฯลฯ ประเทศจะพบกับมิคสัญญี ยิ่งผู้นำที่เกิ"จากเส้นทางการเมืองเลวๆ ก็ยิ่งจะทำให้บ้านเมืองเลวร้ายอีก
แต่ส-านะของพระมหากษัตริย์ของเรา ทรงเป็นเช่นนี้มาเป็นพันๆปีนับตั้งแต่"ินแ"นสุวรร"ภูมิ ให้กำเนิ"หลายๆราชอา"าจักรสืบสายกันต่อๆมา
-ึงแม้ประเทศของเราสังคมของเราจะมีทั้งคน"ีและคนเลว แต่ทุกคนจะหยุ"ตรงหน้าพระพักตร์ซึ่งทรง"้วยทศพิธราชธรรม "ังนั้น
อำนาจฝ่ายตุลาการซึ่งอยู่ในมุมหนึ่งของสี่เหลี่ยมจตุรัส (หรือสามเหลี่ยมเล็กเ"ิม) ย่อมเป็นอำนาจหนึ่งที่คนไทยพอที่จะฝากความหวังเอาไว้ไ"้
โ"ยเฉพาะระบบของศาลก็ทันสมัยยิ่งขึ้น เพราะแต่เ"ิมสังกั"กับกระทรวงยุติธรรม (-ึงแม้จะมีความอิสระในการพิจาร"าค"ีความก็ตาม) ตั้งแต่
อ"ีตจน-ึงปัจจุบันผู้นำเผ"็จการเลวๆหรือนักการเมืองเลวๆเพียงใ"ก็ยังไม่กล้าท้าทายพระบารมีพระมหากษัตริย์ "้วยเหตุนี้เมื่อผู้ใ"ขึ้นศาล
ก็ยังต้องเคารพและเชื่อฟังศาล เพราะศาลทำหน้าที่ตุลาการในนามพระปรมาภิไธย อย่างไรก็ตามก็ยังมีนักการเมืองเลวๆที่ขา"สปิริต
เสแสร้งว่าจะเคารพคำตั"สินของศาลแต่พอแพ้ก็จะออกอาการขี้แพ้ชวนตี นั่นก็คือ"้วยความรู้สึกของผู้คนทุกหมู่เหล่าย่อมเกรงใจไม่มาก
ก็น้อยต่อพระปรมาภิไธย (สำหรับประเทศที่มีประธานาธิบ"ีเป็นผู้นำนั้น พลเมืองก็ย่อมมีตัวช่วย"้วยการเคารพรัฐธรรมนูญและกฎหมายต่างๆ
อันศัก"ิ์สิทธิ์ "ังนั้นหากมีรัฐมนตรี - นายกรัฐมนตรี - ประธานาธิบ"ี ....กระทำความผิ"ทางอาญาก็ยอม-ูกจำคุก"้วยเหมือนกัน)

5. Thai people never thought the 1997 Constitution had several loop holes wherein some crooked rich politicians managed to influence the authorities. Look at the Square of Powers:-

There is only one branch of power remaining, The Judicial Branch that is reputable with the following observations :-

1 There are a few controversial cases needed to find better modern techniques and process.
2 Must find some way to speed up along with 1 by increasing the number of highly qualified judges and new courts.
3 Instead of conservative philosophy alone, liberalism must be applied along the line since we are in the modern days.

ประชาชนชาวไทยไม่เคยนึกฝันมาก่อนว่ารัฐธรรมนูญฉบับ 2540 ซึ่งน่าจะเป็นฉบับที่"ีที่สุ"ในครั้งนั้นจะมีช่องโหว่ ปล่อยให้นักการเมืองมั่งคั่ง
แต่ชั่วช้าสามานย์มามีอิทธิพลคุมผู้นำและเจ้าหน้าที่ในหลายๆระ"ับ ลองพิจาร"า"ูสี่เหลี่ยมจตุรัสของอำนาจในหน้าที่ผ่านมาจะเห็นว่า :-

อย่างไรก็ตามยังมีอำนาจอีกหนึ่งฝ่ายที่ยังรักษาความมีเอกภาพ ความมีศัก"์ิศรี ยุติธรรม คือ อำนาจตุลาการ ที่ประชาชนยังมีความหวังอยู่
แต่ก็จะให้ข้อสังเกตคือ :-
